** APPLICATION / REQUEST to Use Flewellyn's Facilities

GUIDELINES FOR USE OF CHURCH FACILITIES

·  Contract must be signed prior to using the facility.
·  The person signing the contract for the reservation of the facility must be present at the event.
·  Church activities take precedence over non-church activities
·  Any facility must be reserved by contacting Administrative Assistant at 615 382-2136.
·  No person under the age of 18 is authorized to reserve facility without adult over 18
·  Refundable deposit of $50.00 is required for all non-church related activities other than weddings.  The deposit will be refunded if criteria after the activity is met.
·  Audio-visual equipment may be used for a fee of $25.00 for a party, and may only be operated by an authorized church individual.
·  There will be a $500.00 charge for a wedding or reception for church members and non-church members. Church members and non-members will also pay $100.00 for a church wedding representative to be present. 
·  Any damage to the facility or equipment due to neglect, or mis-use will be the responsibility of the person signing the contract.
·  The person signing the contract is responsible to furnish kitchen supplies, napkins, cups, plates, etc.  Use of kitchen appliances other than refrigerator is not allowed.
·  The stage and sound room in the Family Life Center are off limits.
·  No sports or ball-playing during church fellowship events or other church functions unless authorized by the Deacon body, or the House and Grounds Committee.
·  No provocative dancing during any event.  Provocative dancing is defined as partners rubbing against each other, or any individual making any obscene gesture while dancing.  Obscene gesture is defined as any act that may be perceived as obscene or offensive.
·  No provocative or foul language music is allowed.  Provocative music is defined as music speaking of drugs, alcohol, sex or violence.
·  Facilities are open for reservations to all church attendees (members and non-members) as long as they agree to abide by the church rules and regulations.
·  No pets are allowed in any of the facilities at any time.
·  No alcohol or drug use will be allowed.
·  No lock-in’s or overnight activities on Saturday night unless it is a church function pre-approved by the deacon body.
·  One scheduled function per day in any facility.
·  Key Code (Code box located on the back door of the kitchen) will be issued when the deposit is turned in and the contract is signed.
·  No smoking in any facilities or on the church grounds.
·  Functions scheduled for a Saturday are to end prior to 5 p.m. with clean-up completed in order to set up for the Sunday service.
·  No functions should be held on Sunday as this is a church day.

Fee Agreement: 
Owner (Flewellyn Baptist Church) agrees to let User use the USER (see Name above) for the purpose described above. 



Melissa Jones, Administrative Assistant for Flewellyn Baptist Church is the contact person for Owner and USER is the contact person for User. User agrees to pay the Owner $50.00 security deposit for use of the premises.  The security deposit is refundable provided that all guidelines have been followed, and building is clean, air and/or heat are turned down, trash is removed, all floors swept or vacuumed, and mopped clean if needed, all lights turned out, doors are shut and locked and there is no damage to premises.



User agrees to hold harmless, indemnify and defend Owner (including Owner’s agents, employees, and representatives) from any and all liability for injury or damage including, but not limited to, bodily injury, personal injury, emotional injury, and property damage which may result from any person using the premises, its entrances and exits, and surrounding areas, for User’s purposes, regardless of whether such injury or damage results from the negligence of the Owner (including Owner’s agents, employees and representatives) or otherwise.



User agrees to be responsible for preparing for use and returning to the pre-use condition all areas of the premises which the User will use, including entrances and exits.



User agrees to conduct a visual inspection of the premises, including entrances and exits, prior to each use, and warrants that the premises will be used only if it is in a safe condition.



This agreement may be cancelled by either party with within fourteen (14) days. 



In the event Owner must cancel this agreement, User’s deposit to reserve the premises will be returned.  In no way will the Owner be held responsible and liable for lost profits or incidental, indirect, special, or consequential damages arising out of User’s inability to use the premises, even if the Owner has been advised of the possibility or such damages.



Owner and User agree that any disputes arising under this agreement will be resolved via mutually acceptable alternative dispute resolution process.  If Owner and User cannot mutually agree upon such a process, the dispute will be submitted to a three (3) member arbitration panel of the American Arbitration Association for final resolution.



*ORGANIZATIONAL USERS, User promises and warrants that is carries liability insurance. The User will provide a copy of the insurance certificate to the Owner at least seven (7) days prior to the date the User begins to use the facility.
